CHARLESTON – A Georgia couple is suing Bob Evans Farms after the husband fell outside the restaurant chain’s Cross Lanes location.
Thomas Edgar Thompson and Sheila Ann Thompson filed the lawsuit Jan. 13 in Kanawha Circuit Court.
The Thompsons, who live in Covington, Ga., dined at the Cross Lanes eatery on Jan. 20, 2004. As they left the restaurant, they say the walkways were covered in ice and snow.
The suit, filed by Putnam County attorney G. Wayne Van Bibber, says Thomas Edgar Thompson slipped and fell on the ice while trying to exit the restaurant.
As a result of his fall, Thompson sustained permanent and serious injuries to his left hand, resulting in mdical expenses in excess of $3,700.
In addition, the suit says he also endured pain and suffering and a loss of enjoyment of life.
His wife claims she suffered from loss of society, companionship, consortium, comfort, guidance, kindly offices, services and advice of her husband. So she sues for a loss of consortium as well as the value of household services and assistance.
They seek compensatory damages not in excess of $75,000 as well as pre-judgment interest and other relief.
They request a jury trial.
The case has been assigned to Circuit Judge Jim Stucky.
