WINFIELD – A Poca couple is suing over injuries the husband received in two separate automobile accidents.
Martin K. Douglas and Angela B. Douglas filed the lawsuit March 16 in Putnam Circuit Court.
Douglas says he was driving his 1991 Subaru Legacy on W.Va. 34 near Scott Depot on March 18, 2004, when a Kenworth tractor trailer –driven by Anthony Wayne McQueen of Port Royal, Va., and owned by WM Madison Hauling Inc., based in Richmond, Va. – collided with his car.
Douglas says he suffered severe and lasting physical and emotional injuries in that accident.
Then, on May 10, 2005, Douglas says he was driving a 2004 Toyota Highlander in South Charleston when a 1999 Ford van – driven by David Andrew Garrett of Nitro and owned by Jerry N. Hilbert – rear-ended his vehicle.
Douglas says the physical and emotional injuries from that wreck aggravated those injuries from his previous accident.
His wife also is suing for loss of marital consortium.
The couple lists damages as past and future mental anguish and distress; past and future pain and suffering; past and future medical expenses; past and future lost earnings and lost earning capacity; past and future loss of household services; loss of spousal consortium; past and future aggravation, annoyance and inconvenience; past and future loss of enjoyment of life; attorney fees; court costs; and pre- and post-judgment interest.
The couple is being represented by Nitro attorney Thomas H. Peyton. The case has been assigned to Judge O.C. “Hobby” Spaulding.
