MORGANTOWN – A Wetzel County man is suing because of a car accident in which he was involved in Farmington.
Rickey Kinkade filed a lawsuit June 7 in Monongalia Circuit Court against Denzil Efaw, Davis Electric Co. and Michael Tarpley. He also lists his wife Christina and children Jenessa, Alyssa and Colby as plaintiffs.
He says he was driving June 22, 2005, on Route 250 when Efaw ran a truck owned by Tarley, the owner of Davis Electric, into his car.
Kinkade says Tarley and Davis Electric are liable for the collision and that he has “endured pain and suffering, mental anguish, disappointment, worry, emotional pain and suffering, physical injury, emotional distress, psychological trauma, annoyance and inconvenience and other irreparable harm.”
The complaint adds that Christina “will be deprived the society, companionship, comfort, guidance, advice, protection, care and assistance provided by her husband… as a result of the acts of the defendants.”
His children claim the same. The plaintiffs are seeking compensatory and general damages.
Crystal Castleberry of Castleberry Law Offices in Morgantown is representing the Kinkades.
Judge Robert Stone has been assigned the case.
