CHARLESTON – A Beckley man has filed a suit against Hooters, after he was injured when his chair broke during his meal.
Dustin Stewart filed the suit April 1 in Kanawha Circuit Court against Hooters of Kanawha City.
According to the suit, Stewart went to the restaurant July 11, 2007, for a meal. He was seated on a wooden stool at a high top table.
“At some point during the meal, Mr. Stewart leaned up from the table and the round surface of the stool popped off the wooden posts of the leg, landing him in the floor,” the suit says.
Stewart claims he suffered injuries to his back and neck and had to receive medical treatment, which exceeded $20,000.
According to the suit, Stewart endured pain and suffering, mental anguish, emotional distress and a loss of ability to enjoy life.
Stewart seeks compensation for his injuries.
Attorney Anthony M. Salvatore is representing Stewart. The case has been assigned to Judge Jennifer Bailey Walker.
