CEREDO – A Wayne County woman has filed suit against Speedway SuperAmerica after she says she slipped on a wet floor.
Kelly Napier claims she was visiting the Speedway on Main Street in Ceredo on Feb. 2 when she turned to the right to circle the counter, slipped on a wet floor and fell.
According to the complaint filed Aug. 21 in Wayne Circuit Court, Napier was injured in her body and mind, sustained physical and mental pain and suffering, experienced a diminished ability to enjoy life, suffered embarrassment, humiliation, annoyance and inconvenience and incurred medical costs.
Speedway, which did not have a sign warning of the wet floor, was negligent by failing to inspect the premises and by failing to discover the unsafe condition, by failing to warn the public of any dangerous conditions and by training employees whose duty it was to inspect and maintain a safe area on the premises, the suit states.
Napier is seeking an unspecified judgment, plus pre- and post-judgment interest, court costs, attorney’s fees and other relief the court deems just.
Kenneth P. Hicks of Huntington will be representing her.
The case has been assigned to Wayne Circuit Judge James Young Jr.
