CHARLESTON — Two Kanawha County men are suing General Motors, LLC, after they claim a vehicle they purchased was defective.
On Aug. 15, 2008, David K. Gillespie and David L. Gillespie purchased a 2008 Chevrolet Cobalt from the defendant, according to a complaint filed April 26 in Kanawha Circuit Court.
The plaintiffs claim after purchasing the vehicle, they discovered and experienced repeated non-conformities with the vehicle and returned it on at least five occasions for repairs.
The defendants failed to bring the vehicle into conformity with the warranties and failed and refused to provide a comparable replacement vehicle or reimburse the plaintiffs, according to the suit.
The plaintiffs are seeking revocation of acceptance of the vehicle and compensatory damages with pre- and post-judgment interest. They are being represented by David L. Grubb and Cameron S. McKinney.
The case has been assigned to Circuit Judge Tod J. Kaufman.
