CHARLESTON — An Eleanor man is suing Sedgwick Claims Management Services for discrimination based on his disability.
Mark Wilson was employed by the defendant from Nov. 19, 2007, until July 18, 2011, according to a complaint filed May 18 in Kanawha Circuit Court.
Wilson claims during his employment he consistently performed his duties in a satisfactory manner and met the reasonable expectations for the defendant.
On July 18, 2011, Wilson was terminated from his employment with the defendant, according to the suit.
Wilson claims on May 31, 2011, he informed his supervisor that he was ill and on June 1, 2011, he notified the defendant that he would be applying for extended medical leave due to his poor health.
On June 13, 2011, Wilson was diagnosed with a serious and potentially fatal disease and he informed the defendant, according to the suit.
Wilson claims he was undergoing medical treatment for his disease when the defendant terminated his employment.
The defendant’s actions were willful, wanton and/or undertaken with reckless disregard and/or reckless indifference to the rights of Wilson, according to the suit.
Wilson claims the defendant terminated his employment in violation of the West Virginia Human Rights Act.
The defendant’s actions were willful and malicious and caused Wilson to suffer damages, according to the suit.
Wilson is seeking compensatory and punitive damages with pre-judgment interest. He is being represented by G. Patrick Jacobs.
The case has been assigned to Circuit Judge James C. Stucky.
