Former employee sues GNC for wrongful termination

CHARLESTON — A Raleigh County woman is suing General Nutrition Corporation after she claims she was wrongfully terminated from her employment.

Kirstie Meadows, an employee of GNC, was also named as a defendant in the suit.

Diana Oxley was employed as an assistant manager of GNC in Beckley and had been employed by the company for 30 years prior to termination, according to a complaint filed June 27 in Kanawha Circuit Court.

Oxley claims the defendants terminated her employment due to a cash handling violation and falsification of company documents involving failure to account for a check made payable to GNC in the amount of $173.75 on Dec. 29, 2011.

The defendants terminated Oxley’s employment based on her age, which violated the West Virginia Human Rights Act, according to the suit.

Oxley claims the defendants’ termination of her employment was not based on corporate policy, but were made in an effort to justify the termination of her employment.

The defendants’ actions caused Oxley humiliation, distress, embarrassment and anguish, according to the suit.

Oxley is seeking back pay; reinstatement; and compensatory and punitive damages with pre- and post-judgment interest. She is being represented by William M. Tiano.

The case has been assigned to Circuit Judge James C. Stucky.

    They fired 3 women in bucks county Pa. All 3 have been with the company 20 to 30 years. GNC shouldn’t be allowed to get away with this!!! We were dedicated employees to them! All 3 of us were replaced my young men 30 years old and younger!
