Six heirs say Reserve Oil & Gas installed pipeline without permission

CHARLESTON – Six heirs are suing Reserve Oil & Gas, Inc., after they claim it trespassed onto their property and installed a gas pipeline without their permission.

Sandra Bishop, Kathy Fannin, Connie McDaniel, Steve Fannin, Donna Lilly and Debra O’Dell are the heirs of Katherine E. Fannin and as such, are owners of property in Kanawha County that was conveyed from Katherine E. Fannin in Will Book 436 at Page 595, according to a complaint filed Dec. 10 in Kanawha Circuit Court.

The plaintiffs claim Reserve Oil & Gas went onto their property and installed a gas pipeline without their permission.

The installation of the pipeline has caused great harm and damages to the plaintiffs’ property, according to the suit, and the trespass upon their property was committed with full knowledge by the defendant that they did not own the property and did not have permission to go onto the property.

The plaintiffs claims Reserve trespassed upon their property with full knowledge that it was their property and not property of Reserve, which caused them damages.

Reserve’s actions were so outrageous that no reasonable person should be expected to endure and tolerate the actions, according to the suit.

The plaintiffs are seeking compensatory and punitive damages. They are being represented by Timothy J. LaFon.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
