HUNTINGTON – An Ohio woman and her husband are suing Cartree Restaurant Group in federal court after she sustained injuries while at its Huntington location.
Cartree Restaurant Group operates the Arby’s Restaurant on U.S. 60 East in Huntington.
On Aug. 26, 2011, Melody Hill and Steve Hill were at the Arby’s Restaurant in Huntington, according to a complaint filed Feb. 5 in the U.S. District Court for the Southern District of West Virginia's Huntington Division.
Melody Hill claims she was walking toward the restroom of the restaurant when she slipped in a clear substance believed to be pooled water and fell
There were no measures taken by the defendant to warn invitees of the condition, according to the suit.
The Hills claim the defendant knew or should have known of the hazardous condition.
As a result of the defendant’s negligence, Melody Hill suffered serious injuries, according to the suit.
The Hills claim the defendant’s negligence caused them to incur medical expenses; loss of wages; loss of earning capacity; disfigurement and scarring; physical pain and suffering; mental pain and suffering; and loss of capacity to enjoy life.
Steve Hill has also lost the services, society, companionship and consortium of his wife as a result of the injuries she sustained, according to the suit.
The Hills are seeking compensatory damages in an amount greater than $75,000 with pre-judgment interest. They are being represented by Matthew L. Clark and Joe M. Supple.
