Man sues State Police for car accident injuries

CHARLESTON - A Putnam County man is suing the West Virginia State Police for injuries he sustained in a car accident caused by one of its state troopers.

On June 6, 2011, Peter W. Sizemore was involved in a motor vehicle accident whereby Wendy Marie Comer, while on duty in her official capacity as a West Virginia State Trooper, negligently struck the front left side of Sizemore's vehicle and caused him to veer off the road and strike an electric pole, according to a complaint filed April 15 in Kanawha Circuit Court.

Sizemore claims as a result of the defendant's negligence and carelessness, he sustained damages and injuries, including broken ribs, a permanent back injury, medical expenses, loss of earning capacity and loss of enjoyment of life.

The defendant's actions also caused Sizemore pain and suffering; mental anguish; annoyance and inconvenience; and aggravation, according to the suit.

Sizemore is seeking compensatory damages. He is being represented by David O. Moye and Lisa M. Moye of Moye Law Office.

The case has been assigned to Circuit Judge Jennifer Bailey.
