LOGAN -- A Wyoming County couple is suing a hospital and a doctor alleging two foot surgeries were unnecessary and have caused permanent injury.
Sheila and Jeffrey Toler filed a lawsuit Jan. 17 in Logan Circuit Court against Jeffrey Shook D.P.M. and Logan General Hospital LLC, doing business as Logan Regional Medical Center, citing medical malpractice.
The lawsuit states Sheila Toler suffered a work-related injury Dec. 14, 2011, when a bread rack ran over her left foot. She went to an appointment with Shook at Logan Regional Medical Center on Jan. 12, 2012, to address the pain, the complaint states.
He advised a surgery, but told her surgery failed when the pain was continuing.
A second surgery was done, but Toler said the pain continued, according to the complaint. The lawsuit states that neither surgery was necessary for her injury and the surgeries have left her with permanent injuries and pain.
She and her husband are suing for medical expenses, lost wages, diminished earning capacity, loss of household services, pain and suffering, physical injuries, emotional distress, disfigurement, embarrassment, impairment, punitive damages, loss of consortium, pre-judgment and post-judgment interest, attorney’s fees and court costs.
The couple is being represented by Charles M. Johnstone II Esq. of Johnstone and Gabhart LLP. The case has been assigned to Circuit Judge Roger L. Perry.
