Motel worker says he was wrongly fired over workers' comp claim

CHARLESTON -- A motel worker is suing his employer, alleging he was fired for filing a workers' compensation claim.


Brian Sawyer filed a lawsuit March 18 in Kanawha Circuit Court against Motel 6 O.L.P., G6 Hospitality L.L.C., motel manager Josh Gilmore and Jeffrey Peek, citing labor law violations, disability discrimination, retaliatory discharge, assault and battery, negligence, liability and intentional/negligent infliction of emotional distress.

The lawsuit states Sawyer began working for the motel as a general manager on June 2. His wife, Tammy Peek, also worked at the motel and Jeffrey Peek began calling and harassing the motel wanting to speak to Tammy Peek, the complaint said.

Peek then assaulted Sawyer at the motel and Sawyer filed a workers compensation claim. Sawyer was fired by Gilmore after he applied for the claim and states that he wasnt paid all his wages.

Sawyer is seeking a permanent injunction ordering the motel to stop engaging in unlawful conduct, back pay and all benefits, front pay and benefits, compensatory damages, out of pocket losses, punitive damages, plus court costs.

He is being represented by Mark L. French of Criswell French Condaras P.L.L.C. The case has been assigned to Circuit Judge Loius H. Bloom.
