Man sues energy company for work injuries

Workinjury

MORGANTOWN – A man is suing URS Corporation after he claims he was injured while working.

URS Corporation is formerly known as Flint Energy Services Inc.

M3 Mindstream LLC, which is doing business as Momentum; Utica East Ohio Midstream LLC; and John Doe Co. were also named as defendants in the suit.

On May 17, 2013, Timothy Street was instructed to work on a meter station, which required him to stand on a ladder and hold a water line, according to a complaint filed May 15 in Monongalia Circuit Court.

Street claims the water line was connected to a truck owned by Doe and operated by employees/agents of Doe.

The plaintiff was never properly trained on OSHA guidelines and requirements, putting him at risk while working on the meter station, according to the suit.

Street claims none of the defendants provided him with adequate training or adequate fall protection.

Doe's agents/employees caused the water line to be pressurized when it should not have been, which knocked Street off of the ladder, according to the suit.

Street claims he fell off the ladder, causing a fracture to the radial head of his left elbow.

As a direct and proximate result of the actions, omissions and conduct of the defendants, Street suffered injuries to his left elbow, including a fracture and joint effusion, requiring medical treatment and surgery, according to the suit.

Street claims he sustained physical pain and suffering; mental anguish and suffering; permanent physical impairment; loss of capacity to enjoy life; medical expenses; annoyance, aggravation, inconvenience, embarrassment and humiliation; and other damages.

URS failed to provide a reasonably safe place in which to work, which caused Street serious injury, according to the suit.

Street is seeking compensatory damages. He is being represented by Stephen P. New and Amanda J. Taylor of the Law Office of Stephen P. New.
