CHARLESTON – A Fayette County man is suing Genesis Healthcare for injuries he sustained from its alleged negligence during his residency.
Hidden Valley Center was also named as a defendant in the suit.
Harry Waugh Sr. was a nursing home resident of the defendants from June 26, 2013, until Sept. 24, 2013, according to a complaint filed in Kanawha Circuit Court.
Waugh claims the defendants had a duty to provide him with an appropriate and adequate resident care plan and assessment of functional capacity and risk of skin breakdown.
On June 26, 2013, Waugh was admitted to Hidden Valley Center for rehabilitation and assistance with his activities and daily living, according to the suit. Waugh and his family expected Hidden Valley to provide him with the quality care as required by law.
Waugh claims during his residency, he suffered from serious injuries from a pattern of poor care, neglect and abuse rendered by Hidden Valley and their staff, including skin breakdowns.
The negligence and abuse of Waugh by the defendants caused significant destruction of his physical and mental condition during his residency at the facility, according to the suit.
Waugh claims the defendants were negligent and caused him to sustain bodily injuries resulting in pain and suffering; mental anguish; inconvenience; physical impairment; loss of capacity for the enjoyment of life; aggravation of existing diseases and physical defects; and incurred medical expenses.
Waugh is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart of the Bell Law Firm.
The case is assigned to Circuit Judge Jennifer Bailey.
