Woman files class action suit against employer

WHEELING - A woman alleges that her employer failed to pay her and other employees through regular channels or during regular time periods.

Melissa Sheridan has filed an action against her employer, Maxim Healthcare Services Inc., on June 5 in Ohio Circuit Court on behalf of all employees who were discharged in the last five years and not paid their wages “within the period of time required by law and … through their regular pay channels.”

Sheridan was terminated from her job on Dec. 12, 2014, and did not receive all her wages until on or after Dec. 19, 2014. She says that although she usually received her wages via direct deposit, her last check was issued as a paper check that she had to pick up from her employer.

Sheridan is asking that each member of the class action be awarded the damages of no more than $75,000. As well as pre- and post judgment interest as provided by law, attorneys’ fees and costs, injunctive relief and any relief that the court may deem just.

The plaintiff is represented by Rodney A. Smith, Jonathan R. Marshall and Tony L. Clacker II of the Baily & Glasser, LLP, and Todd S. Bailess and Joy B. Mega of Bailess Law, PLLC, both of Charleston.
