American Legion seeks extra funds for Wheeling baseball team

WHEELING - American Legion Athletic Club filed a lawsuit in Ohio County Circuit Court on Dec. 2, seeking to allow JPMorgan Chase Bank, as trustee for the American Legion Athletic Club Trust, to alter its distribution schedule.

American Legion set up a trust in 1968 to help finance its baseball team. The original trust agreement allegedly allowed the trustee to make discretionary distributions, which have usually been around 4 percent.

The American Legion now seeks an additional payout from the trust through its complaint as the trustee will not increase the distribution without court approval.

The payout would benefit the American Legion Post No. 1 baseball team in Wheeling.

The American Legion seeks additional payouts under the trust it set up with the defendants. They are being represented by attorney Donald J. Tennant Jr.
