Woman sues apartment complex, alleges cabinet crash

CHARLESTON - A woman is suing AMS Properties after she claims she was injured on its property while visiting her daughter.

AMS is doing business as Village Hill Apartments Complex.

On March 9, Anna Short was lawfully on the defendant's property visiting her daughter, who is a resident of one of its apartments, according to a complaint filed Dec. 4 in Kanawha Circuit Court.

Short claims she was cleaning the top of her daughter's refrigerator and was kneeling on the kitchen counter when the unsecured cabinet tipped forward, throwing her into the cabinets on the other side of the kitchen.

As a result of the defendant's negligence in failing to secure the kitchen cabinet to the wall, Shirt sustained severe and permanent injuries to her person, including a fractured tibia plateau, according to the suit.

Short claims she also suffered a loss of enjoyment of life and medical expenses.

Short is seeking compensatory damages. She is being represented by Lia DiTrapano Fairless of DiTrapano Law Firm PC.

The case has been assigned to Circuit Judge James C. Stucky.
