MCP Enterprises sued for contract breach

BECKLEY -- A Raleigh County business is being sued after allegedly not paying according to the terms of a credit and rental agreement.

United Rentals of North America Inc., as successors to RSC Equipment Rentals Inc., filed a lawsuit Jan. 7 in Raleigh Circuit Court against MCP Enterprises, citing breach of open contract, quantum meruit and unjust enrichment.

The complaint states on June 25, 2010, the plaintiff and defendant entered into a credit and rental agreement. The plaintiff contends the defendant owes $14,479.43 for goods and services provided. The plaintiff has made demands for payment and the defendant has refused to pay, according to the complaint.

United Rentals of North America Inc. is seeking $14,479.43 in damages, plus interest and costs. The plaintiff is being represented by attorney Steve R. Bratke of McNeer, Highland, McMunn and Varner LC.
