Woman says Fruth Pharmacy didn't pay her overtime before she was fired

POINT PLEASANT -- A Kanawha County woman is suing a former employer, claiming she was denied payment of overtime earned before her employment was terminated.


Kellie Ann Slater filed a lawsuit on Jan. 10 in the Mason Circuit Court against Fruth Pharmacy Inc., citing breach of contract.

Slater alleges in the suit she began working as a cashier for the defendant in March 2007, at Cross Lanes in Kanawha County. Slater claims that during her employment for the defendant she would consistently work overtime without compensation. According to the defendant's Employee Guidelines employees that work overtime are to be paid 1.5 times the employee's hourly rate. The manager would alter Slater's time entries in the computer to reduce the actual time she worked, threatening Slater with termination if she clocked in more than 40 hours a week.

Slater is seeking damages, interest, attorney's fees and court costs. She is being represented in the case by Charleston attorneys John H. Skaggs of The Calwell Practice LC.
