Woman blames Boone Co. nursing home for relative's death

MADISON -- A Boone County woman is suing over claims a relative sustained injuries in a nursing home that led to his death.


Mary Steele, individually and on behalf of the estate and wrongful death beneficiaries of Boyd Steele, filed a lawsuit Jan. 10 in Boone Circuit Court against Advocat Inc., Diversicare Leasing Corp, Diversicare Management Services Co., Sterling Health Care Management Inc., Omega Healthcare Investors Inc., Steven Gardner, Kathryn Kutil, John Does 1 through 10 and Unidentified Entities 1 through 10 (as to Boone Nursing & Rehabilitation Center).

According to the complaint, from May 12, 2011, through Nov. 23, 2011, Boyd Steele was a resident at Boone Nursing & Rehabilitation Center, which was owned, operated and staffed by the defendants and where Steele suffered personal injuries, including falls, infections, pneumonia, COPD and hypoxia. According to the lawsuit, these injuries lead to his death on Jan. 15, 2012.

The defendants are accused of corporate negligence, medical malpractice, malice and/or gross negligence, fraud, breach of fiduciary duty and premises liability.

Steele is seeking damages in an amount to be determined by the court. She is being represented in the case by attorneys James B. McHugh, Michael J. Fuller, and D. Bryant Chaffin of McHugh Fuller Law Group.
