Worker blames Res-Care after patient attacks her

CHARLESTON -- A healthcare employee is suing the home health agency that employed her after a patient attacked her.


Carrie Pettry filed a lawsuit Feb. 4 in Kanawha Circuit Court against Res-Care Inc., citing negligence and deliberant intent.

The lawsuit said Pettry was employed by Res-Care on March 5, 2012, and was sent to perform daily chores for a patient on March 15, 2012. Res-Care is a home healthcare agency for the disabled, but Pettry had no prior experience and states the company did not train her for special needs patients.

The female client attacked Pettry while she was in the patient’s home, sending Pettry to the hospital, according to the complaint.

Pettry is seeking damages to fully compensate her for injuries and damages sustained, pre and post-judgment interest, plus court costs.

She is being represented by Robert Warner of Warner Law Offices P.L.L.C. The case has been assigned to Circuit Judge James C. Stucky.
