Debt collector accused of harassment

BECKLEY -- A Raleigh County woman is suing a debt collector, claiming harassment.


Tammy Holdren filed a lawsuit March 5 in Raleigh Circuit Court against Eisenburg, Whitman and Associates LLC, citing violations of the West Virginia Consumer Credit and Protection Act, the West Virginia Computer Crime and Abuse Act and the West Virginia Telephone Harassment Statute, as well as infliction of emotional distress and invasion of privacy.

Holdren claims she received multiple phone calls from the defendants in order to annoy and harass her into paying debts owed the defendant. According to the claim, the defendant tried to collect the debts due in ways which are in direct violation of several laws put into place in the state of West Virginia.

Holdren is seeking damages, attorney's fees and court costs.

She is being represented by Fayetteville attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young and Pollard PLLC. The case has been assigned to Circuit Judge H. L. Kirkpatrick.
