Timber dispute results in lawsuit

BECKLEY -- A Raleigh County man is suing over claims a timber company breached a contract with him for cutting timber.

Thomas Kevin Link, doing business as TKL Timber, filed a lawsuit April 11 in Raleigh Circuit Court against East River Timber LLC, citing breach of contract, breach of implied covenant of good faith and fair dealing.

According to the complaint, the plaintiff and the defendant entered into a contract granting TKL Timber the right to cut all timber in a designated lot of 253 acres of land Aug. 6, 2012, and the contract was extended Feb. 6, 2013.

Link says the defendant then informed TKL Timber to cease operations.

Link is seeking more than $200,800 in damages arising from the breach of contract as well as attorney's fees.

He is being represented in the case by attorneys Kyle G. Lusk and Matthew A. Bradford of Kyle G. Lusk & Associates. The case has been assigned to Circuit Judge H. L. Kirkpatrick.
