Woman says lawyer didn't file complaint in time

POINT PLEASANT – A lawyer who since has taken a job with the West Virginia Attorney General’s office has been sued for allegedly failing to file a lawsuit.

Paula Stafford filed her complaint April 4 against James M. Casey. Casey was a private attorney before taking a job in the West Virginia Attorney General’s office in 2012 when Darrell McGraw still was in office.

In her complaint, Stafford says she was involved in a slip-and-fall accident at a West Virginia Department of Agriculture facility. She sustained various injuries.

She says she hired Casey to represent her against the Department of Agriculture, but she was informed sometime after May 2013 that Casey had accepted a job with the West Virginia Attorney General’s office.

She also learned Casey had not filed the complaint on her behalf and allowed the two-year statute of limitations to expire.

She seeks compensatory damages from Casey “in an amount adequate to compensate her for her injuries and damages” as well as interest and court costs.

Casey, who still works in the attorney general’s office, declined comment because the litigation is pending.
