Wayne Co. woman accuses CitiFinancial of predatory lending

Mortgage

WAYNE -- A Wayne County woman is suing over claims she was induced into mortgage loans exceeding the value of her home.

Roxie Ann Adams, formerly known as Roxie A. Hogston, filed a lawsuit April 7 in Wayne Circuit Court against CitiFinancial Inc., formerly known as Associate Financial Services Co., citing predatory lending.

According to the complaint, Adams and her ex-husband were induced by the defendant to refinance their home in 1999 and a month later to refinance again, increasing their indebtedness, and for an amount the plaintiff later found to exceed the value of their home.

Adams says the defendant induced them into excessive interest rates and life insurance. The complaint says that, in 2013, when Adams requested a copy of the account record and the identity of the holder of the loan after her 2012 divorce, the defendant failed to reply.

The defendant is accused of unconscionable inducement, illegal credit insurance, failure to provide statement of account and failure to identify holder.

Adams is seeking damages, attorney's fees, and judgement the loan agreement is unenforceable.

She is being represented in the case by attorneys Bren J. Pomponio and Daniel F. Hedges of Mountain State Justice Inc.
