State blames contractor for damage to overpass

CHARLESTON -- A building company faces a lawsuit after their driver allegedly caused extensive damage to an overpass.

Paul A. Mattox Jr., as secretary of the  West Virginia Department of Transportation Division of Highways, filed suit May 20 in Kanawha Circuit Court against Aspen Builders Inc., doing business as Aspen Corporation.

According to the complaint, on July 25, 2012, a tractor-trailer owned by the defendant was traveling northbound on Interstate 77 near Beckley when it struck an overpass near Mile Marker 43, causing extensive damages.

The negligent behavior of the defendant's employee caused approximately $400,000 in damages to repair the overpass, the suit states.

The state is seeking damages of $400,000, plus costs.

The plaintiffs are being represented by attorney C. Brian Matko. The case has been assigned to Circuit Judge Jennifer F. Bailey.
