Crane company wants paid for services

MOUNDSVILLE -- A crane company is suing for the remainder of a bill for services performed in December.

Maxim Crane Works LP filed suit May 1 in Marshall Circuit Court against Flares & Stacks Inc., citing breach of contract and unjust enrichment.

According to the complaint, in December the defendant entered into three short-term rental agreements with the plaintiff for the use of crane equipment at their gas plant in Natrium.

Upon completion of the agreed upon services Maxim sent an invoice to Flares & Stacks in the amount of $112,748.23. To date, the defendant has only paid $84,561.18, according to the suit.

The plaintiff is seeking the remaining balance of $28,187.05, plus interest and costs.

It is represented by attorney Allen M. Lopus of Clark, Hill, Thorp, Reed. The case has been assigned to Circuit Judge David W. Hummel.
