NEW CUMBERLAND -- A car dealership and manufacturer are facing a lawsuit after safety features in a vehicle allegedly failed.
Tammy and John Haines filed suit May 15 in Hancock Circuit Court against C. Hackett, doing business as C. Hackett Chrysler Dodge-Jeep, and Chrysler Group LLC.
According to the complaint, in March 2012 the married plaintiffs purchased a 2012 Jeep Grand Cherokee Laredo from the defendant's dealership in Newell.
On May 20, 2012, Tammy was driving the vehicle when she suffered a medical emergency resulting in her striking another vehicle and two utility poles. During the accident safety measures in the vehicle failed, including air bags not deploying and the fuel pump not cutting off, causing additional injuries to Tammy.
The defendants are being sued for negligence, liability in tort, breach of implied and expressed warranties and loss of consortium.
The plaintiffs are seeking $75,000 in damages.
They are represented by attorney Daniel L. McCune of Sellitti, Nogay & McCune. The case has been assigned to Circuit Judge David J. Sims.
