Customer blames Kroger for injury from potato display

MOUNDSVILLE -- A Marshall County woman is suing over claims she was injured by a faulty potato display at a Kroger store.

Elsie E. and Robert Whetzel filed a lawsuit July 2 in Marshall Circuit Court against The Kroger Co., citing negligence.

According to the complaint, Elsie Whetzel was at the defendant's store on Lafayette Avenue in Moundsville on July 6, 2012, when she lifted a bag of potatoes from an elevated display and part of the display fell onto her foot, causing serious injury.

The Kroger Co. is accused of negligently assembling the display.

The Whetzels are seeking damages, interest and costs.

They are being represented in the case by attorney Thomas E. White of White Law Offices in Moundsville.
