CHARLESTON – A woman claims she fractured a tooth when she bit on a rock hard substance in a piece of Taco Bell meat.
Olivia Smith filed a lawsuit July 8 in Kanawha Circuit Court against Taco Bell of America, John Doe Meat Packing Company and John Doe Manager, citing negligence, negligente supervision and defective product.
Smith claims she was eating at Taco Bell on May 31 when she bit on a rock-hard substance in a piece of meat. Following the occurrence, Smith spit out the item and wrapped it up, according to the complaint. Smith told Taco Bell employees of the incident, the suit states. They offered her a free meal, but refused to pay for medical costs she incurred.
Olivia Smith is seeking a judgement of more than $74,000, plus compensatory damages, costs and attorney's fees.
Smith is being represented by attorney J.C. Powell of Powell and Majestro in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
