Two companies sue Fox Engineering over nonpayment

RIPLEY -- A Jackson County company and an Ohio company are suing over claims another company has failed to pay for professional engineering and fabrication services.

Pioneer Pipe Inc. filed a lawsuit July 14 and Triad Engineering Inc. filed a lawsuit July 22 in Jackson Circuit Court against Fox Engineering Inc. Triad also names Fox Engineering PLLC and Daniel A. Metheny P.E., citing breach of contract.

According to the first complaint, Fox Engineering contracted Pioneer Pipe on Jan. 7 for fabrication and construction on a project just outside New Martinsville, which it has failed to pay for.

The second complaint states the defendants contracted Triad Engineering in June 2013 for engineering work on a condominium project in South Charleston and a bridge project in New Martinsville. Triad says the defendants have failed to pay the $15,055 principal sum and $2,669 contractual interest.

In both cases, the defendants are accused of breach of contract and unjust enrichment.

Pioneer Pipe is seeking the $23,986 owed for materials and services. It is being represented in the case by attorney Daniel P. Corcoran of Theisen Brock in Marietta, Ohio. Triad is seeking the amount owed plus attorney's fees and further interest. It is being represented in the case by attorney David V. Moore of DV Moore Law PLLC in Charleston. Both cases have been assigned to Circuit Judge Thomas C. Evans.
