Man says Chinese restaurant didn't pay him overtime

CHARLESTON – A man alleges he was not paid fairly for overtime hours he worked.

Joe Mayes alleges he was working for defendant Wok and Roll of Charleston where he was forced to work overtime and other regular hours. However, Mayes was not paid for part of the time he worked, according to the complaint filed Aug. 21 in Kanawha Circuit Court.

Because of his inadequate pay, Mayes says he lost wages, experienced pain and suffering and endured indignity, the suit states. He also suffered embarrassment, humiliation, annoyance, inconvenience and emotional distress, the complaint says.

In his complaint, Mayes seeks various damages, plus attorney fees of $350 per hour, costs, punitive damages, pre- and post-judgment interest and other relief the court deems just.
