DOH wants property owned by billboard company

BECKLEY – A West Virginia government agency is seeking property on which to build a public road.

The West Virginia Division of Highways filed an application to condemn land for public use Oct. 16 in Raleigh Circuit Court from Lamar Outdoor Advertising Corporation and the Raleigh County sheriff/treasurer.

According to the complaint, the Division of Highways has ascertained that traffic conditions require land owned by Lamar Outdoor Advertising in Beckley for the construction of a new public road to become part of the West Virginia state road system.

The petition also states the Raleigh County sheriff/treasurer shall be paid any unpaid real property taxes from the verdict.

The plaintiff seeks determination that the division has the right to condemn the land to be used for the road and a determination of what compensation is just for the current title owner.

The division is represented by attorney Harold B. Wolfe III in Princeton.
