FAYETTEVILLE – A Fayette County woman is suing over claims she was injured when an item fell from its display in a Kroger store.
Betty A. Wolfe filed a lawsuit Oct. 31 in Fayette Circuit Court against Kroger Group Cooperative Inc., citing negligence.
According to the complaint, Wolfe was shopping at the Kroger supermarket in Oak Hill on Feb. 2, when a "walker" fell from the top of a cooler where it had been placed for display, struck her in the head and knocked her to the floor. The complaint states Wolfe experienced headaches, neck pain and occasional nausea after the incident, and it was found that there was soft tissue swelling on the crown of her head and over her trapezius muscles.
Wolfe says she incurred more than $3,700 in medical expenses. The defendant is accused of negligence in improperly placing an item for display so as to cause a danger to customers.
Wolfe seeks damages and attorney fees. She is represented by attorney Paul O. Clay Jr. of Fayetteville.
