Woman slips, falls on dusty floor at Macy's

CHARLESTON – A Lincoln County woman is suing over claims she was injured on the slippery floor of a Macy's store.

Sherry Diann Hughes filed a lawsuit Oct. 15 in Kanawha Circuit Court against Macy's Corporate Services Inc., and John Doe, citing negligence.

According to the complaint, Hughes was shopping at the Charleston Town Center Mall on Nov. 1, 2012, when she entered Macy's on the second-floor, mall-side entrance and slipped on the tile floor, sustaining injuries. The complaint states the tiles were dusty from where an unknown person had been pulling up tiles and replacing them with carpet. The defendants are accused of negligence in failing to provide the plaintiff with a safe place to shop.

Hughes seeks compensatory damages including medical bills, lost wages, lost homemaker services and attorney fees.

She is represented by attorney Michael J. Del Giudice of Ciccarello, Del Giudice and Lafon in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
