CHARLESTON – A man is suing the West Virginia Racing Commission and its commissioners for illegally moving money from one fund to another.
Sometime during 2007 and 2008, WVRC violated state code by illegally transferring $2 million from the West Virginia Greyhound Breeding Development Fund to a separate fund, according to a complaint filed Dec. 23 in Kanawha Circuit Court.
Roger White claims this action is contravention of West Virginia Code, which states that the racing commission must first approve the use of the funds for the construct of two training tracks.
As of the day this action was filed, WVRC has not approved any construction of the two training tracks, according to the suit.
White claims Jack Rossi, Gregory McDermott and Bill Phillips comprise the racing commission and are directed to distribute all funds deposited in the greyhound fund.
The transfer of the $2 million from the greyhound fund is a clear violation of West Virginia code and the money should have remained in the greyhound fund, according to the suit.
White is seeking a declaratory judgment requiring that the $2 million be transferred back into the greyhound fund. He is being represented by H. Wyatt Hanna III.
The case is assigned to Circuit Judge Carrie Webster.
