KINGWOOD – A West Virginia general contracting business recently sued a customer for an alleged breach of contract for work performed.
Marksman Contracting of Bruceton Mills filed a lawsuit on Jan. 20 in Preston Circuit Court against Panhandle Cleaning & Restoration Inc. of Wheeling, alleging failure to pay for services rendered.
According to the complaint, in 2014 Marksman Contracting was contracted to execute construction and remodeling work in multiple locations throughout West Virginia, and that as a result of the alleged breach, Marksman Contracting has suffered both monetary losses and damages.
The suit states that representatives from Panhandle Cleaning & Restoration Inc. further misled Marksman with false statements that assured the plaintiff that payment would be rendered; it also claims that the defendant has treated several other local contractors in a similar manner.
The plaintiff seeks compensatory, special and punitive damages, plus attorney fees and costs. Marksman Contracting is represented by attorney Edmund J. Rollo of Morgantown. Circuit Judge Lawrance Miller is presiding over the case.
