POINT PLEASANT — An Ohio couple has sued the wife’s employers, alleging breach of duty.
Barbara A. Pulver and Lewis E. Pulver of Coolville, Ohio, filed a lawsuit March 18 in Mason Circuit Court against: American Electric Power Company Inc. (AEPCI); American Electric Power Service Corporation (AEPSC); Indiana Michigan Power Company (IMPC); AEP River Operations (AEPRO); U.S. Bancorp; and U.S. Bank, National Association, alleging negligence in a 2012 workplace accident.
According to the complaint, on March 22, 2012, Barbara Pulver was employed as a cook by AEPCI, AEPSC, IMPC and/or AEPRO aboard a towboat navigating the Ohio River and owned by the defendants when a skillet fell off the top of a galley refrigerator and struck her on the head, neck and left shoulder.
Barbara Pulver alleges the defendants owed her a duty to provide a safe workplace and to furnish a seaworthy vessel for that purpose. The plaintiff maintains she was injured due to her employers’ negligence.
She cites past and future physical pain and emotional suffering, loss of enjoyment of life, disability, impairment and disfigurement, past and future medical expenses, lost wages and earning capacity, and loss of consortium and services to her husband.
Pulver seeks actual damages, pre- and post-judgment interest, attorney fees, expenses and costs.
The couple is represented by attorney Frederick Goldsmith of Goldsmith & Ogrodowski in Pittsburgh. The case has been assigned to Circuit Judge David W. Nibert.
