PINEVILLE — A Wyoming County woman is suing a grocery business, alleging premises liability in a fall that incapacitated her.
Edith Poland of Oceana filed a lawsuit June 1 in Wyoming Circuit Court against Goodsons' Supermarket Inc. and Jeffrey Goodson, alleging negligence for injuries she allegedly sustained in a 2013 fall.
According to the filing, on May 30, 2013, Poland was shopping at Goodsons’ in Welch when she slipped and fell on a rug near the front door. The suit states others came to her assistance because she was immobilized by the accident.
The complaint states the defendant breached its duty of ordinary care by allowing the rug to remain at the entryway where it posed a dangerous condition. Goodson cites permanent and debilitating physical injury, past and future pain and suffering, mental and emotional distress, loss of mobility, aggravation, annoyance and convenience, and an increased chance of future injury.
The plaintiff alleges loss of income, earning capacity and household services along with medical bills.
Poland seeks compensatory damages, pre- and post-judgment interest, attorney fees and costs. She is represented by attorney Thomas H. Evans III of Oceana. The case has been assigned to Circuit Judge Warren Randolph McGraw.
