Woman sues after slipping, falling at Nitro Wal-Mart

CHARLESTON – A woman is suing Wal-Mart after taking a fall at its store at Nitro Marketplace.

Sandra Watters claims Wal-Mart was negligent in failing to maintain its premises in a reasonably safe and injury-free condition.

In the suit filed Dec. 2 in Kanawha Circuit Court, Watters says she slid and fell on a soft drink tray, causing permanent injuries during a visit to the store in December 2003.

As a result of the fall, Watters claims she has incurred severe physical and mental pain and suffering, emotional distress, mental anguish, loss of enjoyment of life and physical impairment, all of which are certain to continue in the future.

In the suit, filed by Timothy J. LaFon of Ciccarello, Del Giudice & LaFon, Watters says she has incurred substantial medical treatment and bills and is reasonably certain she will do so in the future.

Also, her husband David Watters claims he has sustained a loss of consortium.

The suit seeks a jury trial to determine the damages.

The case has been assigned to Judge Jennifer Bailey Walker.
