CHARLESTON – The commissioner of the state Division of Highways has sued a Beckley man and a Raleigh County company after an incident that did damage to a bridge in Summers County.

Paul A. Mattox Jr., as commissioner of the West Virginia Department of Transportation Division of Highways, claims that on Dec. 1, 2003, a truck owned by TWP Enterprises in Beaver and driven by Thomas M. Young was carrying a backhoe on West Virginia 20 near Hinton.

While crossing the Lilly Bridge on W.Va. 20, the boom on the backhoe struck beams on the overhead structure of the bridge, causing damage to the bridge structure.

In the suit, filed by Jeff J. Miller of the DOH, the agency claims Young was negligent.

The repairs necessary to fix the bridge totaled $112,527.13. That includes engineering services, labor, equipment and materials.

The suit seeks Young and TWP to pay $129,739.75.

The case has been assigned to Judge Paul Zakaib.
