HUNTINGTON - A Cabell County couple has sued a model airplane manufacturer and a hobby store over an incident involving a design defect.
In a suit filed Dec. 28 in the Cabell Circuit Court, Paul and Loretta Moore allege Mr. Moore sustained serious injuries after working on a Great Planes model airplane that his friend Teresa Alzamora purchased for him at Tower Hobbies.
On Jan. 4, 2004, Moore was installing a spinner component on the airplane when the spinner wire broke loose, piercing his abdomen and puncturing his gall bladder.
Moore was rushed to Cabell Huntington Hospital where he underwent emergency exploratory and reconstructive surgery to remove the 1-inch piece. Less than two weeks later, Moore again underwent surgery to re-insert his intestines into his abdomen.
Moore is suing the manufacturer of the plain, Great Planes, for negligence, defective design and failure to warn. He is also suing the store that sold the plane, Tower Hobbies. Moore claims Tower should have known its products "are free from design defects or flaws."
Moore is seeking damages of $75,000.
The case has been assigned to Judge David M. Pancake.
