Kanawha woman sues drivers, car dealer in accident suit

CHARLESTON – A Kanawha County woman has filed a lawsuit against the two drivers in an automobile accident in which she was a passenger as well as one of the drivers' employer.

Kela El Amin filed the lawsuit Jan. 6 in Kanawha Circuit Court. The defendants are Candi Woodberry in name only, Marshall C. Harless Jr. and Tri-State Used Cars Inc.

In the suit, El Amin says she was a passenger with Woodberry driving a 1997 Pontiac Bonneville traveling east on 6th Avenue in Charleston on Jan. 15, 2004. When Woodberry tried to cross Patrick Street, the vehicle was struck by one driven by Harless.

El Amin says Woodberry is negligent because she didn't have the right of way, failed to keep a proper lookout, pulled into oncoming traffic and failed to maintain control of vehicle. She claims Harless is negligent for traveling too fast, failing to yield the right of way and failing to maintain control of vehicle.

She also says Harless was working for Tri-State Used Cars and driving one of the company's vehicles on a suspended license.

In the suit, filed by attorney Katherine L. Dooley, El Amin says she sustained severe and painful injuries to her person requiring immediate and constant medical attention. She also says she suffered and will suffer great pain of body and mind and has and will incur medial expenses. She also says she has suffered great discomfort, inconvenience, nervousness, diminution in her ability to enjoy life and other injuries and damages.

El Amin seeks compensatory and punitive damages as well as court costs and attorney fees. She requests a jury trial.

The case has been assigned to Circuit Judge Jennifer Bailey Walker.
