WINFIELD – A Cabell County woman claims she was wrongfully terminated by Ogden Directories and her rights were violated.
Misty Faulkner filed the lawsuit Jan. 20 in Putnam Circuit Court.
In the suit, Faulkner says she worked in Ogden's Putnam County office and that she consistently performed her duties in a satisfactory manner and met reasonable expectations of her employer.
But on Dec. 27, 2005, she claims she was illegally and wrongfully fired based, in whole or in part, upon her disability or perceived disability. That, she says, is a violation of the West Virginia Human Rights Act.
The suit, filed by Charleston attorney Mark A. Atkinson, does not disclose what Faulkner's disability or perceived disability is.
Faulkner claims the defendants' actions were "willful, wanton and/or undertaken with reckless disregard and/or reckless indifference" to her rights.
As a result of her termination, Faulkner claims she has suffered and will continue to suffer lost wages and benefits. She also says she has suffered indignity, embarrassment, humiliation and emotional distress.
She also says Ogden, which publishes the EZ To Use Big Book phone books, failed to pay her commissions and/or wages she earned during her employment.
Faulkner seeks damages, including punitive damages, in an amount to be determined at trial as well and pre-judgment interest, attorney fees, court costs and other relief.
She requests a jury trial.
The case has been assigned to Circuit Judge O.C. "Hobby" Spaulding.
