HUNTINGTON – A Huntington woman is seeking damages for injuries she suffered after she tripped and fell over a manhole outside her dentist's office.
In a suit filed Jan. 19, Lisa Milstead claims the city of Huntington, Dr. Frederick H. Sammons and West Virginia-American Water Company are responsible for her fall.
On Dec. 1, 2004, Milstead was visiting her dentist for routine dental work. She parked her car behind the building and walked around to the front entrance. The suit claims while she was walking, she tripped and fell over a manhole cover that was partially extended onto the sidewalk.
As a result, she broke her foot. According to the suit, she suffered pain and mental anguish, medical bills and loss of income.
Her husband, Jay Milstead, also is suing for loss of consortium.
The suit claims the city of Huntington should have known about the "dangerous sidewalk" and should have taken steps to remedy it. It claims Sammons was negligent as a property owner and should have provided a safe environment for his customers.
Milstead also is suing West Virginia-American Water for negligence, claiming the company had a duty to ensure manhole covers didn't create a potential hazard.
She is seeking damages to compensate her for her damages and injuries.
The case has been assigned to Judge David M. Pancake.
