Ohio woman seeks compensation for injuries sustained at concert

CHARLESTON – An Ohio woman has sued after injuring herself at an outdoor concert last year in South Charleston.

Regina Hampton filed the lawsuit against B&P Promotions and Bristol Broadcasting Company Inc. on Jan. 27 in Kanawha Circuit Court.

The Belpre, Ohio, resident says that on May 28, 2005, she was attending the WQBE Rabbit Jam concert at Oakes Field in South Charleston when "she sustained injuries to her knee when she was forced to make way for swaying and falling scaffolding."

She claims the defendants failed to exercise due care to protect her from injury, failed to maintain the premises in a reasonably safe condition, failed to warn concert attendees of risk of injury from dangerous conditions, failed to warn of non-obvious dangers, failed to make inspections to discover unsafe conditions and failed to take action to repair or remove dangerous conditions.

Hampton says she sustained severe injuries, required medical treatment and may have exacerbated pre-existing conditions.

She says she has incurred significant medical expenses, a loss of earnings and wages, pain and suffering, inconvenience, annoyance, humiliation, embarrassment, mental and emotional distress, mental anguish, harm, physical injuries and aggravation and/or exacerbation of pre-existing medical conditions.

She seeks a joint and several judgment in compensatory, general and special damages, as well as exemplary and punitive damages to be determined by a jury. She also seeks pre- and post-judgment interest, attorney fees, court costs, expenses and other relief.

Hampton requests a jury trial.

The case has been assigned to Circuit Judge Tod Kaufman.
