Martinsburg furniture store sued again

MARTINSBURG - A month after the Martinsburg Schewel Furniture store was sued for overloading a truck, a Williamsport, Md., woman says she was hit in the head by a falling glass picture frame there.

Ruth Zepp filed a lawsuit Nov. 16 in Berkeley Circuit Court against Schewel Furniture Co.

The alleged occurrence took place Nov. 23, 2004.

"While on the showroom of the premises, Plaintiff sat in a reclining chair on display for sale by the defendant," the complaint says. "The chair struck a glass picture frame displayed only inches away from the chair.

"The frame fell upon the plaintiff and struck her upon her head, neck, back and shoulders."

She says the situation created was a hidden danger or pitfall and Schewel failed to warn her. Zepp adds that her medical bills exceeded $11,000.

She seeks other compensation for pain, emotional trauma, permanent impairment, disability, scarring and diminished capacity to enjoy life.

The lawsuit seeks $74,500.

Bradley Reed of Hagerstown, Md., is representing Zepp.

The other recent lawsuit filed against Schewel says its employees helped a man overload his truck with furniture that then fell out on Interstate 81, causing a car wreck.

Judge David Sanders has been assigned both cases.
