Wheeling restaurant hit with two lawsuits

WHEELING - Two lawsuits were filed against a Wheeling restaurant, each claiming the owner did not uphold his contracts.

Ohio Valley Amusement Company and Island Rentals filed separate suits in Ohio Circuit Court against John Simmons and The Batting Cage Pub and Eatery Inc.

The suit filed by Ohio Valley Amusement on Feb. 27 states Simmons violated the lease contract, which was signed on Sept. 3, 2004. The lease was a 10-year lease, but the suit says Simmons failed to uphold his part of the agreement.

Ohio Valley Amusement, under counsel of Randy Dean Gossett, seeks judgment from the court against Simmons.

The lawsuit filed by Island Rentals on March 2 seek payment for several business loans, which totaled $33,751.

Island Rentals, through counsel Gerald G. Jacovetty Jr., seeks payment for the loans, as well as 10 percent interest.
