* The Thackers were driving on Oct. 25, 2006 near Hurricane when Drunkel collided with another car, causing that car to collide with the Thackers. They sustained personal injuries and other economic harm. They seek compensatory damages, including current and permanent or future personal injury, personal suffering, medical expenses, lost wages, aggravation, annoyance, and inconvenience, loss of earning capacity, loss of ability to enjoy life. They also seek attorney fees, costs and pre- and post-judgment interest.

Barbara Fletcher vs. James R. Casto and State Farm Mutual Automobile Insurence Company

* On May 23, 2005, Fletcher's vehicle was struck by a vehicle and attached trailer driven by Casto. Fletcher made a claim against Casto under the Liability coverage of an Erie policy. Through council, Fletcher placed State Farm on notice of her claim and her intent to pursue all available coverage under the State Farm policy. Erie then tendered its liability policy limits to Fletcher in exchange for a release of liability for Casto. State Farm then acknowledged coverage and waived subrogation rights. Fletcher then resolved her claim against Erie for the limits of the liability policy. As a result, Fletcher released and discharged any and all liability clains against Casto. Fletcher demands judgment against the Defendants.
